L&#8217;ind\u00e9pendance des ISC est une priorit\u00e9 essentielle du Plan strat\u00e9gique de l&#8217;INTOSAI.<\/p>\n\n\n\n<p>Guid\u00e9 par le souci de l&#8217;ind\u00e9pendance de l&#8217;institution qui prot\u00e8ge les d\u00e9penses de l&#8217;argent public en Pologne depuis plus de 100 ans et sa capacit\u00e9 \u00e0 s&#8217;acquitter de ses responsabilit\u00e9s constitutionnelles, le pr\u00e9sident de l&#8217;Office supr\u00eame de contr\u00f4le de Pologne, M. Marian Bana\u015b, a demand\u00e9 l&#8217;\u00e9valuation rapport sur les restrictions syst\u00e9miques \u00e0 l&#8217;ind\u00e9pendance de la Cour supr\u00eame des comptes de Pologne (NIK). Un organisme ind\u00e9pendant, l&#8217;Initiative de d\u00e9veloppement de l&#8217;INTOSAI (IDI), a \u00e9labor\u00e9 le rapport en utilisant le M\u00e9canisme ind\u00e9pendant de plaidoyer rapide (SIRAM) de l&#8217;ISC. Le rapport comprend des \u00e9valuations, des conclusions et des recommandations d&#8217;experts de l&#8217;IDI. Le m\u00e9canisme de plaidoyer rapide pour l&#8217;ind\u00e9pendance des ISC (SIRAM) a \u00e9t\u00e9 cr\u00e9\u00e9 en 2018 pour d\u00e9fendre et sensibiliser aux menaces et aux violations de l&#8217;ind\u00e9pendance des ISC, ainsi que pour apporter un soutien aux ISC confront\u00e9es \u00e0 des d\u00e9fis pour leur ind\u00e9pendance. La m\u00e9thodologie SIRAM vise \u00e0 d\u00e9terminer si les principes d&#8217;ind\u00e9pendance contenus dans les D\u00e9clarations de Lima et de Mexico (INTOSAI P-1 et INTOSAI P-10 respectivement) ont \u00e9t\u00e9 enfreints.<\/p>\n\n\n\n<p>L&#8217;\u00e9quipe d&#8217;experts, sur la base des \u00e9l\u00e9ments de preuve recueillis, des consultations avec les parties int\u00e9ress\u00e9es et des analyses men\u00e9es, a sans aucun doute constat\u00e9 la violation de plusieurs principes importants de la D\u00e9claration de Mexico sur l&#8217;ind\u00e9pendance des ISC (INTOSAI P-10), y compris le Principe 2 &#8211; ind\u00e9pendance des Chefs d&#8217;ISC et membres d&#8217;institutions coll\u00e9giales, Principe 3 \u2013 mandat suffisamment large et pleine discr\u00e9tion dans l&#8217;exercice de leurs fonctions, Principe 4 \u2013 acc\u00e8s illimit\u00e9 \u00e0 l&#8217;information pour s&#8217;acquitter correctement de leurs responsabilit\u00e9s statutaires. En outre, l&#8217;\u00e9quipe a \u00e9valu\u00e9 une \u00e9ventuelle violation significative et r\u00e9aliste du principe 8 &#8211; en r\u00e9duisant le budget de NIK et, par cons\u00e9quent, en limitant consid\u00e9rablement la capacit\u00e9 de NIK \u00e0 accomplir ses t\u00e2ches constitutionnelles.<\/p>\n\n\n\n<p>Il est important de noter que l&#8217;ampleur des violations des principes de la D\u00e9claration de Mexico sur l&#8217;ind\u00e9pendance des ISC peut susciter des inqui\u00e9tudes quant \u00e0 l&#8217;ordre public en Pologne et, par cons\u00e9quent, \u00e0 l&#8217;ind\u00e9pendance du NIK qui a \u00e9t\u00e9 \u00e9nonc\u00e9e dans la Constitution. La mesure dans laquelle les principes sont enfreints place la Pologne au premier rang des pays d&#8217;Afrique, d&#8217;Am\u00e9rique latine et des Balkans orientaux.<\/p>\n\n\n\n<p>Le rapport de l&#8217;IDI formule d&#8217;importantes recommandations \u00e0 l&#8217;intention des parties prenantes, notamment le gouvernement polonais et le pr\u00e9sident du Sejm polonais, indiquant la n\u00e9cessit\u00e9 de prendre les mesures n\u00e9cessaires pour prot\u00e9ger l&#8217;ind\u00e9pendance du NIK. Les recommandations comprennent la nomination des membres du Conseil du NIK, la garantie d&#8217;un acc\u00e8s rapide aux informations lors des audits et la recherche d&#8217;un moyen de fournir des financements appropri\u00e9s au NIK.
